Criminal Penalties

Sanctions imposed by the court. Other license suspensions and license reinstatement requirements are determined by the Registry of Motor Vehicles (RMV)

First Offense

Imprisonment for up to 2½ years.
Fines can range from $500-$5,000.
One (1) year suspension of driver’s license by court.

First offenders can opt to Tender a Plea that involves a period of probation, completion of a 32 hour Impaired Driver's course, 45-90 day license suspension (in addition to any other OUI-related license suspension), and fines.

Second Offense

Imprisonment for 60 days to 2½ years. Must serve minimum of 30 days.
Fines range from $600-$10,000.
Two (2) year suspension of driver’s license by court.
Alcohol education program

Second offenders can opt to Tender a Plea that involves a period of probation, completion of a 14-day residential alcohol treatment program, aftercare (outpatient) alcohol program, license suspension, and fines.

Third Offense

Imprisonment for 180 days to 5 years. Must serve minimum of 150 days.
Fines range from $1,000 to $15,000.
Eight (8) year license suspension
Mandatory installation of ignition interlock device.
Alcohol education program.
Revocation of vehicle registrations.

Fourth Offense

Imprisonment for 2 to 5 years. Must serve minimum of 12 months.
Fines range from $1,500 to $25,000.
Ten (10) year license suspension
Mandatory installation of ignition interlock device.
Alcohol education program.
Revocation of vehicle registrations.

Fifth Offense

Imprisonment for 2 1/2 to 5 years. Must serve minimum of 24 months.
Fines range from $2,000 to $50,000.
Lifetime license revocation
Mandatory installation of ignition interlock device.
Alcohol education program.
Revocation of vehicle registrations.
